LIFE OPTIMIZATION MENTORING AGREEMENT
This agreement is entered into by and between Jeff Kippel and Mindy Blackstien (Mentors), and Client, who have registered online and accept these terms and conditions.
Description of Mentoring:
Mentoring is a partnership (defined as an alliance, not a legal business partnership) between the mentors and the client in a thought-provoking and creative process that inspires the client to maximize personal and professional potential. It is designed to facilitate the creation/development of personal, professional or business goals and develop and carry out a strategy/plan to achieve those goals.
Human Potential International (HPI) Mentoring is a consciousness and mindset transformation process that inspires and supports clients' in achieving their goals, realizing their potential, and transforming their actions and habits.
Responsibilities:
- The mentors follow the Human Potential International Code of Ethics and uphold the Human Potential International values and principles stated on the Human Potential International website www.humanpotentialinternational.com.
- The client is responsible for creating and implementing their own decisions, choices, actions and results. The client agrees that the mentors are not and will not be liable for any actions or inaction or any direct or indirect result of any services provided by the mentors. Further, the client understands mentoring is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.
- The client understands that mentoring is not to be used as a substitute for professional advice by legal, mental, medical or other qualified professionals and will seek independent professional guidance for such matters. For example, if the client is currently under the care of a mental health professional, the mentors will recommend that the client inform the mental health care provider.
- The client agrees to communicate honestly, be open to feedback and assistance and create the time and energy to participate fully in the program.
Services:
The parties agree to engage in a Life Optimization Program through video and or telephone meetings. In addition, the mentors will be available to the client by e-mail and text messages in between scheduled meetings.
Call Procedure and Cancellation Policy:
The time of the mentoring calls will be determined by the mentors and the client based on a mutually agreed-upon time. The mentors will initiate all scheduled calls and will contact the client for all scheduled meetings. If the client cannot make the scheduled call, it is the client's responsibility to notify the mentors and reschedule with reason.
If the client blatantly misses the scheduled call and chooses not to inform the mentors of their reasons, they will not be required to rebook an additional call.
Confidentiality:
The mentor/client relationship and all information (documented or verbal) that the client shares with the mentor are bound to confidentiality but is not considered a legally confidential relationship (like in Medicine or Law). The mentor agrees not to disclose any information about the client without the client's written consent. The mentor will not disclose the client's name as a reference without the client's consent. Confidential information does not include information that:
(a) was in the mentor's possession before its being furnished by the client;
(b) is generally known to the public or in the client's industry;
(c) is obtained by the mentor from a third party, without breach of any obligation to the client;
(d) is independently developed by the mentor without use of or reference to the client's confidential information; or
(e) that the mentor is required by law to disclose.
Limited Liability:
Except as expressly provided in this agreement, the mentors make no guarantees or warranties, express or implied. In no event will the mentors be liable to the Client for consequential or special damages. Notwithstanding any damages that the client may incur, the mentor's entire liability under this agreement and the client's exclusive remedy will be limited to the amount paid by the client to the mentor under this agreement for all services rendered until the termination date.
This is the parties' entire agreement and reflects a complete understanding of the parties concerning the subject matter. This agreement supersedes all prior written and oral representations.
If a dispute arises from this agreement that cannot be resolved by mutual consent, the Client and Mentor agree to attempt to mediate in good faith for up to 30 days after the notice is given. If the dispute is not resolved, and in the event of legal action, the prevailing party shall be entitled to recover attorney's fees and court costs from the other party.
